We advise on the understanding of the general cross-cutting public law acts such as the Danish Public Administration Act (forvaltningsloven), the Danish Public Information Act (offentlighedsloven) as well as the General Data Protection Regulation and the Danish Data Protection Act (databeskyttelsesloven) and on matters about the legal basis or interpretation of the special acts in the individual public administration areas.

It is very important to us to understand all the challenges facing our clients, what is required of the legal solutions and how they are to be implemented. Our advice is often to serve as the basis for decision-making and a proposed solution to enable our clients to move forward and minimise or clarify the risk of criticism from the Danish Ombudsman or the potential risk of the solution being set aside by the courts.

Our advice may be provided as a legal opinion (a statement) or a memorandum, but often an email or a brief discussion will be sufficient, depending on our clients’ specific needs.

The reasons why clients contact us with questions about legal basis, statutory interpretation or general administrative law rules are many. The need may arise during a project in which the political or financial investment has been heavy and quality assurance is required.

It may also be a delimited, but difficult, matter of doubt needing clarification. Lastly, some clients have a clear picture of what they believe is the proper solution before they seek assistance, but require verification of the result (a second opinion).
