Contracts and tenders

The rules governing contracts and tendering are many and complex, and things can easily go wrong. Disputes may be unavoidable, and many matters are ultimately brought before the Danish Complaints Board for Public Procurement or the courts of law. A tendering process should therefore always start with thorough planning.

Meticulous tendering process from planning to contract

We have extensive experience in planning tendering processes and tailoring programmes that cater to our clients’ special requests and needs. We are used to handling the often complex legal and practical issues that arise as a result of the special circumstances and requirements to which public authorities are subject. If we are not advisors to the contracting entity, we also advise bidding tenderers.

We aim to know and understand the business and reality of our clients, and we are dedicated to providing advice that can be used in practice, advice that solves problems and not just identifies problems. We therefore work closely with our clients to ensure that we achieve useful and durable solutions that provide value for money for our clients.

As part of our advisory services, we often participate in project groups with consultants and other advisors, and we take part in negotiations with tenderers/suppliers – often in customised negotiation processes.

The durable tendering process

Our main field of expertise is contracts and tendering regarding products, services and building/construction. We have separate tender teams specialised in tendering and contracts related to technology and digitalisation, construction and defence and security.

We take part in the process of procuring goods and services of any kind – from standard goods to complicated, custom-designed products and services. We also advise employers in connection with tendering of Danish and international consultancy and construction contracts (for example, the new hospitals in the Capital Region, the Fehmarnbelt Fixed Link, offshore wind farms and miscellaneous road, bridge and railway projects).

We advise contracting entities (and tenderers) in connection with tendering of miscellaneous contracts, including in respect of:

• Infrastructure projects
• Concessions
• Large acquisitions
• Public transport procurement, including contract management, change management, etc.

Disputes may be unavoidable. When disputes arise, we help our clients achieve a settlement solution, if possible. If an amicable solution is not within reach, we litigate our client’s case before complaints boards, arbitration tribunals and the courts of law.
