Public projects and cooperation

We assist with implementing projects and establishing cooperation between public authorities and/or private organisations.

A number of practical and legal questions arise in connection with the implementation of a public project and/or establishment of cooperation between public authorities, with the possible participation of private organisations:

  • Which entities should participate in the project/cooperation?
  • How should the project be financed?
  • How should the project be managed?
  • Which employees should be included and how?
  • What should be the duration and what happens afterwards?

With our assistance, the project or cooperation will be established in a manner that is financially sound and based on a suitable and tenable legal model.

We will involve all elements in our advice on the establishment of projects/cooperation so that business partners, stakeholders, clients and other parties involved are taken into account in the process. The outcome will be a model and a solution creating confidence and value.

The first step is to identify the purpose and scope of the project/cooperation; which entities should participate/be involved; and how should it be financed and managed. Then an act or a ministerial document is to be prepared and the necessary contractual/corporate set-up established.

We advise on all these aspects, including in relation to:

  • any drafting of legislation;
  • establishment of the cooperation;
  • handling of employees;
  • contractual parties;
  • process management.

We have advised on the establishment of projects and various forms of cooperation for many years and we combine our specialist knowledge of the public administration in Denmark with our expertise in company law, foundations law, administrative law, labour and employment law, municipal law, finance law, appropriations law, state aid law, competition law, EU law and contract law.
